This leaflet describes the process for filing Section 36 applications for compensation for violations of rights recognized under the Persons with Disabilities Rights and Protection Act, 2013. It explains the definition of “discrimination” under the Act, who can file an application, whom applications can be filed against, how long the Act specifies for district committees to resolve the applications, where the applications should be filed, and what you can do if you have trouble filing your application. It also includes a list of the criminal offenses and corresponding punishments established under Section 37 of the Act, including: impeding a person with disability from accessing the justice system, preventing a person with disability from receiving inheritance, embezzling the property of a person with disability, disseminating negative or false information about persons with disabilities, or falsifying disability identification cards
You can use this leaflet to distribute at trainings and awareness-raising events so that participants can easily access basic information about the Section 36 application process and also as a handy reminder for them that they can report conduct criminalized by the Act under Section 37.
